Terms and Conditions for MyHairQue

1. Acceptance of Terms

By accessing or using the MyHairQue platform, website, or mobile application (collectively, the "Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of the terms, you may not access the Platform.

2. MyHairQue's Role as a Booking Intermediary

2.1. Nature of the Service

MyHairQue operates solely as a booking agency and technology intermediary. We provide a Platform that connects users seeking specialized hair services ("Clients") with independent, third-party hair specialists and salons ("Stylists").

2.2. Limitation of Liability for Services Rendered

MyHairQue is not the employer, agent, or representative of any Stylist. The agreement for the hair service is a direct contractual relationship between the Client and the Stylist.

Quality of Services: MyHairQue does not guarantee, endorse, or warrant the quality, safety, legality, suitability, or standard of any services provided by a Stylist. Stylists are solely responsible for all professional standards and outcomes of their services.

Damages and Disputes: In the event of a dispute, dissatisfaction, personal injury, or damage arising from any service performed by a Stylist, the Client agrees that MyHairQue shall not be held liable. The Client must seek remedies and resolution directly with the Stylist.

2.3. Maximum Liability of MyHairQue

To the maximum extent permitted by Belgian law, MyHairQue's maximum liability to any Client or Stylist arising out of the use of the Platform is strictly limited to the total booking fee collected by MyHairQue for the specific transaction that gave rise to the claim.

3. Client Obligations, Fees, and Consumer Rights

3.1. Client Fees and Payment

Clients can sign up for free. A service fee of €3.50 (exclusive of VAT/BTW/TVA) is charged by MyHairQue per successful booking. The final invoiced amount to the Client will include the applicable VAT rate. This fee is for the use of the Platform's booking technology and is separate from the service price charged by the Stylist.

3.2. VAT Responsibility

Clients acknowledge that Stylists are solely responsible for determining, collecting, and remitting any applicable VAT/BTW/TVA on the price of the hair services they provide.

3.3. Right of Withdrawal (14-Day Cooling-Off Period)

As required by EU consumer law, Clients have a 14-day right of withdrawal for online contracts. However, for services booked through the Platform:

Service Fee: The Client's right to withdraw and claim a refund of the €3.50 booking fee expires when the service has been fully performed (i.e., immediately after the appointment is completed).

Stylist Service: The right of withdrawal for the hair service itself is governed by the Stylist's separate cancellation policy, which must be clearly disclosed at the time of booking. The right of withdrawal typically expires the moment the service begins (when the Client sits in the chair).

3.4. Stylist Cancellation Policies

Clients agree to abide by the individual Stylist's cancellation and rescheduling policies as listed on their profile. MyHairQue is not responsible for enforcing or refunding payments related to the Stylist's service fee.

4. User Accounts and Security

4.1. Account Creation and Age Requirement

To use certain features of the Platform, including booking an appointment or leaving a review, you must register for an account. By creating an account, you represent and warrant that you are at least 18 years of age, or accessing the Platform under the supervision of a parent or legal guardian who agrees to be bound by these Terms.

4.2. Account Responsibilities

You are solely responsible for maintaining the confidentiality of your account login credentials. You agree to provide accurate information and notify MyHairQue immediately of any unauthorized use of your account.

5. Payments and Data Security

5.1. Payment Processing

Payment processing services are provided by third-party processors (e.g., Stripe). By making a booking, you agree to be bound by the respective payment processor's Terms of Service.

5.2. Data Security

MyHairQue does not directly store your full credit card information. All payment data is handled by our PCI-compliant payment partners to ensure maximum security.

6. Reviews and User-Generated Content

6.1. Content Ownership, Portfolios, and "Before & After" Galleries

Clients and Stylists may have the opportunity to upload photos, including "Before and After" transformations, reviews, and portfolio images ("User Content").

Ownership: You retain all ownership rights to your User Content.

License Grant: By submitting User Content, you grant MyHairQue a worldwide, non-exclusive, royalty-free, transferable license to use, display, reproduce, and distribute your content in connection with operating and marketing the Platform (including on our social media channels).

Consent and Image Rights: If you upload a photograph featuring a recognizable person, you strictly warrant and represent that you have obtained explicit, written consent from that individual to display their likeness publicly. MyHairQue reserves the right to immediately remove any images if a subject withdraws their consent or if an intellectual property claim is made.

6.2. Content Standards

Reviews must be honest and based on actual experiences. We reserve the right to remove content that is defamatory, abusive, discriminatory, or fraudulent.

7. Data Protection and Privacy (GDPR)

7.1. Privacy Policy

MyHairQue strictly adheres to the General Data Protection Regulation (GDPR). By using the Platform, you acknowledge our Privacy Policy, which details how we collect, process, and protect your personal data.

7.2. Data Sharing

By making a booking, you explicitly consent to the transfer of necessary personal data (name, contact information) to the relevant Stylist to enable the performance of the service contract.

8. Intellectual Property

All content, logos, and software on the Platform are the proprietary property of MyHairQue. You may not copy, scrape, or reproduce any part of the Platform without express written permission.

9. Termination of Use

MyHairQue reserves the right to suspend or terminate your account at any time for violations of these Terms, including repeated "no-shows," abusive behavior, or suspected fraudulent activity.

10. Dispute Resolution and Governing Law

10.1. Governing Law

These Terms shall be governed and construed in accordance with the laws of Belgium.

10.2. Jurisdiction

Any legal proceedings shall be subject to the exclusive jurisdiction of the competent courts in Antwerp, Belgium.

10.3. EU Online Dispute Resolution (ODR)

Clients may also use the European Online Dispute Resolution Platform to resolve disputes.
